Gorge Journal · 259 Three Mile Road · Day 2 of 30
Fifteen acres in Lee County is enough land to cross two thresholds in Kentucky law. At ten contiguous acres a tract can qualify as agricultural land for assessment if it is used that way, and at ten acres in agricultural or forestry use the state’s water quality act asks for a written plan. 259 Three Mile Road has open lawn around the house and wooded edges beyond it. Here is what managing both involves, and who in Beattyville helps.

Two state thresholds a 15-acre tract crosses
Agricultural land for assessment. KRS 132.010(9) defines “agricultural land” as any tract of at least ten contiguous acres used for agricultural purposes, and Kentucky’s county PVAs read that definition to include timber production. The definition is about use, not size alone: a fifteen-acre tract mowed as lawn is not agricultural land, and the same tract cut for hay, grazed, or managed for timber may be. The Lee County Property Valuation Administrator at 667 Tip Top Road in Beattyville decides how this parcel is classed; ask before assuming.
The water quality plan. The Kentucky Agriculture Water Quality Act, administered by the Energy and Environment Cabinet, requires landowners with ten or more acres in agriculture or silviculture operations to develop and implement a water quality plan based on the state’s guidance. Lawn and woods that are left alone do not trigger it. Hay, livestock, or a timber harvest do. The plan is written by the landowner from the state’s published guidance, and the county Extension office helps with it.
The wooded edges
The drone stills show the house on a ridge with woods along the edges of the open ground. In Kentucky the first call for a private woodland owner is the Division of Forestry’s Forest Stewardship Program, which the Cabinet describes as free to all private forestland owners. A state forester walks the property and writes a management plan that covers what is growing, what to remove, and how to handle the creek edges.
If timber is ever sold from those edges, the Kentucky Forest Conservation Act applies. Under KRS 149.344 and 402 KAR 3:030, any timber harvesting operation must use the state’s best management practices to protect water quality and correct any problems the harvest causes. The MLS record says there are creeks on this land, so those practices, which are mostly about keeping soil out of streams, are not theoretical here.
The open lawn
Open acreage around a house is either mowed or leased. Mowing at this scale means equipment sized for it, or a contractor, and the seller can tell you which they use and what it costs each season. Leasing the open ground for hay or grazing turns lawn into agricultural use, which is where the two thresholds above enter: a possible change in how the PVA classes the land, and a water quality plan to write.
Questions for the seller during the inspection period: who maintains the open ground now, whether any of it has been in hay or pasture, whether any timber has been cut, and whether a forester has ever written a plan for the woods. The answers go in your file next to the disclosure form.

Questions buyers ask
Does 15 acres qualify for Kentucky’s farmland assessment?
Only if it is used for agricultural purposes. KRS 132.010(9) sets the floor at ten contiguous acres in agricultural use, and county PVAs include timber production in that use. The Lee County PVA decides for this parcel; a licensed CPA can tell you what the classification means for your taxes.
Do I need a water quality plan for 15 acres?
Only when ten or more acres are in agriculture or silviculture operations. A mowed lawn with untouched woods does not trigger the Kentucky Agriculture Water Quality Act. Hay, livestock or a timber harvest does, and the plan is written from the state’s guidance with help from the Extension office.
Can I cut timber on the wooded edges?
It is your land, so yes, but a commercial harvest falls under the Kentucky Forest Conservation Act, which requires best management practices to protect water quality. Start with the free Forest Stewardship Program plan from the Division of Forestry so the decision is made from a forester’s inventory rather than a guess.
