Kentucky Deed Requirements a Gorge Land Clerk Will Check

Kentucky deed requirements are not a formality the county clerk can waive. A deed missing the in-care-of tax address, the sworn consideration certificate, or the immediate source of the grantor’s title is a deed the clerk is instructed not to record — and on Red River Gorge land, where parcels come out of old patents and family divisions, the source-of-title line is the one that fails.

What must a Kentucky deed contain?

Five things: the full names of grantor and grantee, both mailing addresses, a statement of the full consideration, an in-care-of address for the tax bill, and a sworn notarized consideration certificate.

Those five sit in KRS 382.135(1), and the statute’s own catchline ends with the words that matter to a closing: the clerk is prohibited from filing a noncompliant deed. The certificate has two forms. A sale uses a sworn, notarized certificate signed by both sides stating that the consideration in the deed is the full consideration paid. A gift or a nominal-consideration transfer uses a certificate saying so and setting out the estimated fair cash value instead.

Why does source of title stop Gorge deeds?

Because a separate statute bars the clerk from recording any conveyance of an interest equal to or greater than a life estate unless the deed plainly specifies the grantor’s immediate source of title.

That is KRS 382.110(2), and subsections (4) and (5) say how specific it has to be. If the source is a recorded instrument, the new deed must refer to that deed or writing and give the office, book and page where it was recorded, and the date of recording. If the grantor took title by inheritance or in any way other than a recorded writing, the deed must state clearly and accurately how and from whom. If title came from two or more sources — the ordinary case for a tract assembled out of a family division — the deed must specify each of them that way.

A hill tract that came to the seller from three siblings and a tax deed needs three book-and-page references and a plain sentence for the fourth. One line reading “being the same property acquired by the grantor” is not a source of title.

Which county records a tract on a county line?

The clerk’s office of the county where the property, or the greater part of it, is located. For Gorge acreage straddling two counties that is a question of acreage, not of which courthouse is closer.

KRS 382.110(1) sets that rule for all deeds, mortgages and other instruments that must be recorded to be effectual against purchasers without notice or against creditors. Gorge parcels sit where Lee, Wolfe, Powell, Menifee and Estill counties meet, and ridge-line boundaries do not respect county lines. The practical consequence for a buyer is the title search: if the greater part lies in Wolfe County, the chain lives in Wolfe County, and a search run only in the county named on the listing can miss it entirely.

Which deeds are exempt from part of the list?

Six kinds, and only from the consideration, in-care-of and certificate requirements — never from the names and addresses, and never from the source-of-title rule.

Exempt from KRS 382.135(1)(c), (d) and (e)
Deeds that only convey utility easements
Deeds transferring property through a court action in a divorce proceeding
Deeds conveying rights-of-way involving governmental agencies
Deeds conveying cemetery lots
Deeds correcting errors in a previous deed, same grantor to same grantee
Deeds conveying real property to a local airport board

Two more provisions catch Gorge sellers. On an exchange of properties, the fair cash value of the property being exchanged must be stated in the body of the deed. And where land passes by will or intestate succession, the personal representative must, before closing out the estate, file an affidavit with the county clerk of each county in which any of the property is located, naming the people receiving each property and its full or fair market value.

What this means for a for-sale-by-owner package

In my experience the deed itself is rarely the thing a seller has thought about. The package that arrives is a photocopy of a decades-old deed, a hand-drawn sketch of the boundary, and a price. None of that is wrong to start from — but the statutory elements above are what converts it into a recordable instrument, and they are all things the seller must supply or sign: the notarized certificate needs both signatures, the in-care-of address needs a decision about who receives the tax bill for the transfer year, and the source-of-title line needs the book and page of every instrument the seller’s title rests on. Ask for those at the start, not at the closing table, because the gap between a photocopied deed and a full chain is usually weeks of courthouse work rather than an afternoon. Where the land came from heirs, that work is its own exercise — see buying Red River Gorge land from heirs. And a recorded deed is not proof the lot was ever legally created: an unapproved subdivision plat can void the deed that describes the lot.

The survey is the other half of the package. What a surveyor can and cannot resolve on steep Gorge ground is covered in the land survey guide for Gorge buyers.

Can the county clerk record a deed that is missing the consideration certificate?

No. KRS 382.135 expressly prohibits the clerk from filing a noncompliant deed, unless the transfer is one of the six exempt types listed in subsection (2).

What counts as a source of title if the seller inherited the land?

Under KRS 382.110(4), a deed whose source is not a recorded writing must state clearly and accurately how and from whom the grantor obtained the title or interest.

Does a correction deed need the full consideration statement?

A deed correcting errors in a previous deed from the same grantor to the same grantee is exempt from the consideration, in-care-of and certificate requirements under KRS 382.135(2)(e).
